1. Acceptance of these terms

These Website Terms govern your access to and use of the North Lake Health website, the clinic portal, and patient ordering accounts (collectively, the “Services”). By using the Services or creating an account, you agree to these terms. If you do not agree, do not use the Services.

2. Who may use the Services

The clinic portal and wholesale pricing are available only to licensed healthcare providers and their authorized staff whose accounts North Lake Health has reviewed and approved. Patient accounts are available to individuals age 18 or older who register through a link provided by an approved clinic. The Services are not directed to children under 13, and we do not knowingly collect information from them.

You are responsible for the accuracy of the information you submit, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without authorization.

3. No medical advice

All product descriptions, ingredient summaries, research references, and educational materials on the Services are provided for general informational purposes only. They are not medical advice, diagnosis, or treatment, and they do not create a provider-patient relationship between you and North Lake Health. Always consult a qualified healthcare professional before starting any supplement, especially if you are pregnant, nursing, taking medication, or managing a health condition.

4. Dietary supplement statements

North Lake Health products are dietary supplements. Statements about these products have not been evaluated by the U.S. Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. See our Product Disclaimer for details.

5. Pricing, orders, and errors

Prices, availability, and product information may change at any time before an order is accepted. All applicable shipping charges and taxes are shown to you before you submit payment. We do not add fees after checkout. If a product is listed at an incorrect price or with an incorrect description because of a technical or clerical error, we may cancel or decline the affected order and will refund any amount already charged.

Submitting an order is an offer to purchase. An order is accepted when we confirm it by email or ship it.

6. Recurring orders

If you enroll in monthly replenishment, the terms in our Auto-Renewal Terms apply, including how to cancel. You may cancel at any time from your account without contacting support.

7. Acceptable use

You agree not to misuse the Services, including by attempting to gain unauthorized access to any account or system, scraping pricing that is restricted to approved accounts, reselling products outside the terms of your account, interfering with the operation of the Services, or using the Services in violation of any applicable law.

8. Intellectual property

The Services and their content, including text, graphics, product photography, formulations documentation, and the North Lake Health name and logo, are owned by North Lake Health or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute this content without our written permission, except that approved clinics may use the patient-facing materials we provide for the purpose of serving their own patients.

9. Third-party services

Payments are processed by Stripe, Inc. Your use of payment features is also subject to Stripe’s terms and privacy policy. North Lake Health does not receive or store full payment card numbers.

10. Disclaimer of warranties

Except for any express warranty stated in a signed agreement or required by law, the Services and the content on them are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free. Nothing in these terms limits any warranty or right that cannot be limited under applicable law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, North Lake Health and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or loss of data, arising out of or relating to your use of the Services. To the maximum extent permitted by law, our total liability for any claim relating to the Services or a product will not exceed the greater of the amount you paid to North Lake Health for the product or order giving rise to the claim, or one hundred U.S. dollars.

These limitations do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

If you use the Services on behalf of a clinic or other business, that entity agrees to indemnify and hold North Lake Health harmless from claims, damages, and reasonable expenses arising from its breach of these terms, its misuse of the Services, or its own clinical decisions and recommendations to patients.

13. Termination

You may stop using the Services or close your account at any time by contacting us. We may suspend or terminate access for violation of these terms, non-payment, failure to complete credential verification, or suspected fraud. Orders already paid for will be fulfilled or refunded.

14. Governing law and disputes

These terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Hennepin County, Minnesota, and both parties consent to that jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your place of residence.

We encourage you to contact us first so we can try to resolve any issue directly.

15. Changes to these terms

We may update these terms. When we make a material change, we will update the effective date at the top of this page and, for account holders, notify you by email before the change applies to future orders. Continued use of the Services after a change takes effect means you accept the updated terms. Changes do not apply retroactively to orders already placed.

16. Miscellaneous

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with any account agreement that applies to you, are the entire agreement between you and North Lake Health regarding the Services.
